Under no circumstances shall Habἱlov Enterprises Ltd. (hereinafter “BeforeDue”) be liable for any losses or damages whatsoever, whether in contract or otherwise, from the use of or reliance on the services offered by BeforeDue. BeforeDue strictly and solely offers the use of its proofreading services for perusal and informative purposes, and requires that its clients do not submit the work of BeforeDue as their own. BeforeDue shall not be liable for any loss howsoever arising or any indirect, special, incidental, or consequential damages, even if advised of the possibility of such damages.

BeforeDue includes all its divisions, subsidiaries, successors, parent companies and their employees, partners, principals, agents, and representatives as well as any third-party providers or sources of material. While BeforeDue takes all necessary precautions to safeguard all submitted documents, it shall not be held liable for the loss of documents due to power failure, hardware/software failure, computer viruses, natural disasters, or any other unforeseen matters and factors beyond our control. You will be responsible for creating back-up and archival copies of your documents. In no event will BeforeDue be responsible to you or any other person for any loss, corruption, or alteration of documents.

CONDITIONS OF USE

As a condition of use, you agree to the following:

• The Service allows Registered Users to upload, transmit, publish, and disseminate text and other content (“Registered User Content”). Any User Content contained on the Service represents the opinion of that Registered User only. No content made available through the Service, including Registered User Content, should be taken as a statement by or from BeforeDue.com, or its subsidiaries, directors, officers, employees, or licensors.
• You are solely responsible for any Registered User Content that is published, transmitted, or disseminated using your Registered User account. You are solely responsible for maintaining the confidentiality of your account information, including your password, and for any and all activity that occurs under your account. You agree to immediately notify BeforeDue.com of any unauthorized use of your account or password, or any other breach of security.
• You will not use the Service to harass, threaten, impersonate, or intimidate anyone.
• You will not upload, post, email, transmit, or otherwise make available any content that is unlawful, harmful, threatening, abusive, harassing, tortuous, defamatory, vulgar, obscene, libelous, invasive of another’s privacy, hateful, or racially, ethnically, or otherwise objectionable.
• You will not upload, post, email, transmit, or otherwise make available any content that is in violation of copyright law, trademark law, or any other law protecting intellectual property in any jurisdiction, or that violates an individual’s right to publicity or privacy.
• You will not upload, post, email, transmit, or otherwise make available any unsolicited or unauthorized advertising, promotional materials, “junk mail,” “spam,” “chain letters,” “pyramid schemes,” “affiliate links,” or any other form of solicitation.
• You will not transmit any worms or viruses or any code of a destructive nature.
• You will not copy, modify, create a derivative work of, reverse engineer, decompile or otherwise attempt to extract the source code of the Service or any part thereof.
• You will not violate any local laws in your jurisdiction (including but not limited to intellectual property laws).
• You will not use the Service for any illegal or unauthorized purpose. If you are an international Registered User, you agree to comply with all local laws regarding online conduct and acceptable content.

CONTENT

When you upload or otherwise provide your own original Registered User Content to or through the Service, you retain ownership of any copyright (and any other rights) you already hold in your Registered User Content. You also represent and warrant that, with respect to all Registered User Content that you upload, transmit, publish, and disseminate through the Service, that (a) you have all the rights and licenses necessary to use, reproduce, publish, display publicly, perform publicly, distribute or otherwise exploit such Registered User Content in connection with the Service, and to grant toBeforeDue.com the licenses set forth in this Agreement; and (b) the Registered User Content will not infringe or otherwise violate the copyright, trademark, or any other right of any third party.

By submitting Registered User Content as set forth above, you hereby do and shall grant toBeforeDue.com and its successors, assigns, and third-party service providers, a worldwide, non-exclusive, perpetual, irrevocable, royalty-free, fully paid, sublicensable, and transferable license to use, reproduce, modify, create derivative works based on, distribute, publicly display, and publicly perform the Registered User Content in any medium and by any means currently existing or yet to be devised. You also hereby do and shall grant to each visitor to and Registered User of the Service a worldwide, non-exclusive license to access, view, link to, and share your Registered User Content solely as permitted by and through the Service and in accordance with these Terms of Use.

BeforeDue.com makes Registered User Content available at its sole discretion and may disable access to any Registered User Content at any time and for any reason. By using the Service, you acknowledge and agree that BeforeDue.com does not guarantee access to and/or hosting of Registered User Content that is published or disseminated through the Service. For example, if Registered User Content violates these Terms of Use, access to it may be disabled.

Replacement and Cancellation Policy

We follow a simple policy regarding the replacement and cancellation of the file. This policy will help to minimize the errors for editing the wrong file. The replacement and the cancellation policy are explained below:

Replacement Policy

• We do not replace files if they are being revised and sent back for editing.
• The file can only be replaced if a completely wrong file is being sent for editing.

Cancellation Policy

• A cancellation will only be allowed if the wrong file has been sent for editing.
• Cancellation must be made by emailing us at info@beforedue.com
• The replacement of the file after the start of editing is considered as a cancellation of the order.
• There is a cancellation fee charged to cancel the wrong file sent and replace it with a completely new document.
• The cancellation fee will be calculated based on amount of work done on the assignment.

Refund after Cancellation

• Transfer fees will be deducted from the refund amount. Also, all additional charges for sending the refund back will be deducted from the refund amount.
• Refund is not possible if any one of the following conditions are met:
  • If the payment is not done using Paypal
  • If the refund amount is less than 100 USD or equivalent
  • Cancellation is after 15 days of placing the order
  • If local invoice with VAT has already been issued
• In such cases, this amount will be adjusted against future orders.
• Note: BeforeDue reserves full discretion over refunds and can offer alternative policies to those listed in these terms and conditions.

E-mail Address

By providing your e-mail address to us, you give us permission to send you regular updates about our services and company. If you ask us specifically not to send e-mails to you, we will stop sending you e-mails.

If your e-mail address is not functional and we encounter issues such as e-mail bouncing, we are not liable for delivery of your files. We will try and contact you once through the contacts provided by you over e-mail. You need to contact us to receive your edited files in such situations.

Delivery of Files

We always deliver edited documents within the deadline promised to you. In case you do not receive your document, please contact us immediately. The accesible download can be viewed through your oder history.

For editing PDF file in PDF delivery format, we require single column documents with double spacing. This is because it is difficult to edit files in double column and single space format, as there is not sufficient room for writing and the final markup is often not legible. In case your documents do not meet the abovementioned criteria, we change the delivery file format to MS Word for maintaining the quality of the edited document. This will help you to clearly see the changes made with the help of track changes.

Your Intellectual Property Rights

BeforeDue and its employees make no claims on any work submitted to us for proofreading or editing. Any documents (“Documents”) submitted will remain your intellectual property. Editors have signed a confidentiality agreement to waive their claim to any intellectual property submitted through our service. You represent that you have obtained all necessary third party rights, including (without limitation) copyrights, for any Documents or portions thereof that belong to third parties. It is your responsibility to determine if it is necessary for you to obtain, and for obtaining, any licenses required to use third party content that is part of the Documents. You agree not to use the services for or provide documents with any infringing, illegal, sexually explicit, threatening, abusive, harassing, defamatory, or racially, ethnically, or otherwise objectionable material, including (without limitation) any materials that could give rise to any liability to BeforeDue or that might adversely affect BeforeDue’s public image, reputation, or goodwill.

Notification Of Changes

BeforeDue reserves the right to modify or amend these Terms of Service at any time with or without notifying you of such changes. The changes will only affect your use of the services after the effective date of the change unless we clearly express otherwise. Your use of the services after BeforeDue provides you with notice of such changes shall be deemed your approval of such changes.

Destruction Of Documents

BeforeDue reserves the right to save documents on its systems according to its policy. If you want us to delete your files specifically from our systems, you need to send us an e-mail stating your need.
